High court imposes ban on formation of Ad Hoc within producer council

Chennai high court has imposed ban on the ‘Ad Hoc’ committee headed by Ibrahim Ravuttar.

In the civil petition filed by producer council’s head SA Chandrasekaran and treasurer S Dhanu against the Ad Hoc committee, it was stated ‘There is issue between Producer’s Council and FEFSI.  On behalf of the General Secretary, general body meeting is called for.’

It was stated that there is contemplation regarding formation of temporary committee, Ad Hoc and there is to be discussion regarding handing over governance of the producer council to the committee.  

Ban should be imposed:

 ‘I sent a notice against the move.  I received telegram that SA Chandrasekaran, Secretary Thenappan and treasurer Dhanu have been removed from post.  Also, there was message that a temporary committee is to be formed.’

 ‘There is no place in the council for formation of temporary committee.  The general body meeting was not gathered on 15.4.2012.  So, ban should be imposed upon formation of temporary committee.’
 
Judge R Subbiah went through the case and issued order:

 ‘The formation of temporary committee is not within producer council’s rules and regulations.  Ibrahim Ravuttar’s side argued that there is place in rules of Producer council for formation of temporary committee.’

 ‘The management could create such committees to govern the moves of the producer council. There is no place in committee for creation of another committee with equal authority.  So we cannot accept the argument.

Ban on Ad Hoc committee:

 ‘Rules say that notice should be sent 21 days before gathering of general body meeting.  SA Chandrasekaran, Thenappan and Dhanu have been directly suspended.  No explanation was sought.  It trespasses law.’

 ‘It violates rules and regulations to form temporary committee in the producer council.  The general body meeting has been called for on 15.4.12 violating council’s rules and regulations.  So ban should be imposed upon ‘Ad Hoc’ committee.’
